PixGT Terms of Service — AI-Powered Services

1. Introduction & Acceptance of Terms

Welcome to PixGT. PixGT is operated by LIU CHANG, an individual sole trader operating under the laws of the People's Republic of China. These Terms of Service (“Terms”) govern your access to and use of our AI-powered services, including AI product imagery, AI clothing try-on, AI model swap, accessory try-on, pose variation, AI video generation, and related image processing features, available at https://pixgt.com (the “Service”).

By creating an account, purchasing credits, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement on behalf of yourself or any organization you represent.

⚠️ Important: If you do not agree to these Terms, you may not use the Service. Continued use after any update constitutes acceptance of the revised Terms.

2. Description of the Service

2.1 What we provide

PixGT provides an AI-powered platform that lets e-commerce sellers, independent stores, and brand merchants generate and edit commercial visual content from their own product photos and prompts. The Service is a digital software-as-a-service (SaaS) product delivered over the internet.

2.2 Nature of the Service

The Service is a digital, intangible product. Access is granted immediately upon payment confirmation. Because of this immediate delivery, specific refund limitations apply — see Section 7.

2.3 Third-party AI model dependency

The Service relies on third-party AI model providers, including Alibaba Cloud Model Studio (Qwen / Wan), ByteDance Volcano Engine (Doubao / Seedream), and Meitu. The performance and availability of the Service may be affected by the operational status of these providers. Material disruptions will be communicated to users promptly.

3. Account Registration

3.1 Creating an account

Using the Service requires creating an account with accurate and complete information. You may register with an email address, or by signing in with Google or Apple. You are responsible for keeping your login credentials confidential and for all activity under your account.

3.2 Account security

• If you become aware of unauthorized use, contact us immediately at mianshinn@foxmail.com.
• Do not share your login credentials with any third party.
• Keep the email address on your account current and monitored — it is where billing and security notices are sent.

3.3 Business accounts

If you register on behalf of a company or organization, you represent that you are authorized to enter into this agreement on behalf of that entity.

4. Credits and Top-Up Packs

The Service operates on a credit system. Users purchase credit packs at any time; there is no subscription and no recurring charge. Credits are consumed when you generate or edit content, at the per-action rate displayed in the product before you confirm each action. Full pricing — pack prices in both currencies, what each generation costs, and the credit validity rules — is published at https://pixgt.com/pricing/, viewable without an account. You can also go straight to checkout.

5. Billing and Payment

5.1 Single top-up authorization

Each top-up is a one-time transaction. By completing a purchase, you authorize LIU CHANGto charge your payment method the amount displayed at checkout. Payments are processed by our payment processor and merchant of record, Waffo Pancake. Your card statement will show a descriptor associated with Waffo Pancake, not a personal name.

There is no auto-renewal and no auto-recharge. We will never charge your payment method again unless you actively start a new purchase and confirm it at checkout.

5.2 Taxes

Unless stated otherwise, listed prices exclude applicable taxes (including VAT, GST, or sales tax). Where required by applicable law, such taxes are collected and remitted by our merchant of record.

5.3 Currency

Prices are displayed in USD or CNY depending on your region, and you may switch currency on the pricing page before purchase. The currency shown at checkout is the currency you will be charged in.

6. Credit Validity and Account Termination

6.1 Credit validity

Credits purchased in a pack are valid for the period stated on that pack at the time of purchase (currently 30 days or 365 days). When a pack expires, any unused credits are frozen rather than immediately cleared: for 90 days after expiry, buying any new pack automatically unfreezes those credits and extends them to the new expiry date. Credits still frozen after that window expire and are not refundable. We send a reminder before credits expire.

6.2 Cancellation and account deletion

Because there is no subscription, there is nothing recurring to cancel. You can stop using the Service at any time without any further charge. If you want your account removed, you can delete it yourself in the product — no email request is required — or contact us at mianshinn@foxmail.com and we will process it. We confirm deletion by email.

6.3 Effect of termination

• Unused credits remaining at termination are retained for 90 days, after which they expire and are not refundable unless applicable law requires otherwise.
• Account data is retained for 90 days after deletion and is then removed in accordance with our Privacy Policy.

7. Refund Policy

Consumed credits are generally non-refundable. The following exceptions apply:

• Unused credits within 7 days of purchase: full refund.
• Duplicate charges: billing errors that result in a duplicate charge are refunded in full.
• Verified service outage: if a failure on our side prevented you from using the Service for more than 72 consecutive hours, we refund pro rata or extend your validity period.
• Failed generations: credits consumed by a generation that failed due to a fault on our side are returned to your balance automatically. If they are not, contact us and we will restore them.
• Statutory rights (EU / UK / Australia): the 14-day right of withdrawal for first-time purchasers is preserved and applies until you first use the purchased credits.

To request a refund, email mianshinn@foxmail.com with your account email and the transaction ID. We acknowledge within 2 business days and, where approved, refund to the original payment method within 5–10 business days.

Refunds are not available for credits already consumed (except as set out above), or for accounts closed for breach of these Terms or of the Acceptable Use Policy.

8. Billing Disputes

If you believe a charge is incorrect, please email mianshinn@foxmail.com before raising a dispute with your bank. We respond within 2 business days and resolve confirmed billing errors within 5 business days. Contacting us first is almost always faster than a chargeback, and lets us fix the underlying problem.

9. AI Content and Intellectual Property

9.1 Ownership of output

Subject to your compliance with these Terms, AI content generated from your inputs (“Output”) belongs to you. You may use the Output for any lawful purpose permitted under Section 10, including commercial use in your own store and advertising.

9.2 License to your input

By submitting content to the Service (“Input”), you grant LIU CHANG a limited, non-exclusive license to use it solely for the purpose of providing the Service to you. We do not use your Input to train AI models without your explicit consent.

9.3 Third-party AI model dependency

The Service uses the third-party AI model providers named in Section 2.3. Output may be shaped by those providers’ models. We do not warrant any particular Output quality and are not liable for content generated by third-party models.

9.4 Accuracy of AI output

AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying Output before relying on it — in particular before using it in advertising or product listings, where accuracy claims are your responsibility as the seller.

9.5 Rights in your uploads

You represent that you hold the necessary rights to every image you upload, including portrait rights for any identifiable person appearing in it, and that your use of the Output will not infringe any third party’s rights.

10. Acceptable Use Policy

10.1 Permitted use

You may use the Service only for lawful purposes consistent with these Terms, including e-commerce product presentation, creative design, marketing production, and related business activities.

10.2 Prohibited content categories

The Service must not be used to generate any of the following six categories of content: (1) sexual / NSFW content; (2) violent / gory content; (3) hate speech; (4) child-unsafe content (CSAM); (5) deepfakes or impersonation of real people; (6) content infringing copyright or trademarks.

These categories, our content moderation systems, the channels for reporting violations, our response times, and the enforcement actions we take are set out in full in our Acceptable Use Policy, which forms part of these Terms.

10.3 Other prohibited use

You further agree not to use the Service to:

• Generate illegal, defamatory, harassing, or fraudulent content.
• Generate, distribute, or assist in producing deepfake content — including AI-synthesized audio, video, or imagery that impersonates a real person or is intended to mislead viewers about its origin or authenticity.
• Generate content that sexualizes minors or otherwise violates child protection laws.
• Produce malware, phishing content, or tools for cyberattacks.
• Infringe the intellectual property or privacy rights of any third party, including uploading images of people without their consent.
• Circumvent or interfere with the security features of the Service.
• Resell or sublicense access without our prior written approval.
• Violate any applicable law, regulation, or card scheme rule.

10.4 AI-specific prohibitions

In addition to the above, and given the AI nature of the Service, you expressly agree not to:

• Use the Service’s inputs, outputs, model responses, or any derived data to train, fine-tune, benchmark, distill, or otherwise develop any artificial intelligence or machine learning model that competes, directly or indirectly, with the Service or with PixGT products.
• Systematically scrape, extract, or harvest model outputs at scale for any purpose beyond your own authorized use.
• Present AI-generated content as the work of a qualified human professional (such as a licensed physician, lawyer, or financial adviser) in contexts where doing so could cause harm.

10.5 Enforcement

We may remove content, suspend, or terminate accounts that breach this Section. Where a breach is not serious and not repeated, we will normally warn you first. The full grading and enforcement ladder is in the Acceptable Use Policy.

11. Data, Privacy, and Security

Your use of the Service is governed by our Privacy Policy. Payment card data is handled exclusively by our PCI-DSS compliant payment processor (Waffo Pancake) and is never stored on our servers. Account data is retained for 90 days after account deletion and then removed.

12. Disclaimers and Limitation of Liability

12.1 Disclaimer

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or the accuracy of AI output.

⚠️ AI-generated content disclaimer: Output from the Service may be inaccurate, incomplete, or out of date. Do not rely on it for legal, medical, financial, or other professional advice. Always verify with a suitably qualified professional before acting on AI content.

12.3 Limitation of liability

To the maximum extent permitted by applicable law, LIU CHANG is not liable for any indirect, incidental, consequential, or punitive damages. Our aggregate liability is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

13. Term and Termination

These Terms remain in effect for as long as you use the Service. We may suspend or terminate your account for a material breach of these Terms, suspected fraudulent activity, or where required by law. If we terminate for reasons other than your breach, we will refund the unused prepaid portion on a pro rata basis. You may delete your account at any time in the product or by contacting mianshinn@foxmail.com.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the People's Republic of China. Before starting any formal proceedings, please email mianshinn@foxmail.com so we can try to resolve the matter informally — in practice this resolves nearly everything. Nothing in this Section deprives a consumer of the protection of mandatory provisions of the law of their country of residence.

15. General Provisions

We may update these Terms from time to time. Material changes will be notified by email at least 14 days before they take effect. Continued use after that date constitutes acceptance. If any provision is held invalid, the remaining provisions stay in full force. These Terms together with the Privacy Policy constitute the entire agreement between you and LIU CHANG.
